These Terms & Conditions (“Terms”) govern access to and use of the Gregorian Chant Academy (“GCA,” “we,” “us,” “our”) online courses and cohorts, related content, communities, and services (collectively, “course”). By enrolling, accessing, or using the course, you (“you,” “Student”) agree to these Terms.

If you do not agree, do not enroll in or access the course.

Governing law & venue: State of Idaho, USA (unless mandatory consumer protection law of your country requires otherwise).

2) Eligibility & accounts

  • You must be at least 18 or have parental/guardian consent.

  • You are responsible for maintaining accurate contact info (especially email) and for the security of your login credentials.

  • Accounts are personal and non-transferable. Sharing login credentials is prohibited.

3) Course description, updates & availability

  • Beta / Early Access. If you enroll (or have enrolled) in a beta, pre-release, or “as-we-build” course/cohort, you acknowledge the Course may be iterative, updated over time, and subject to change, including lesson order, content, schedules, and features. No fixed completion date is guaranteed for beta courses/cohorts.

  • Ongoing improvements. We may revise, enhance, or replace lessons, modules, downloads, and communities to improve quality or clarity.

  • Platform migrations. We may change hosting platforms (e.g., LMS providers) and will provide reasonable instructions to maintain access. You agree to follow our migration instructions and keep your email address current.

  • Downtime. Temporary interruptions may occur due to maintenance, third-party outages, or events beyond our control.

4) License to you (how you may use the content)

Subject to these Terms and your timely payment, GCA grants you a personal, limited, revocable, non-exclusive, non-transferable license to access the Course for your own study and liturgical formation.

What you may do

  • Access the Course for personal learning.

  • Download provided sheet music and handouts for personal use and non-commercial liturgical use (including printing for your parish/schola), keeping attribution and copyright notices intact.

What you may not do

  • Reproduce, rip, copy, share, upload, stream, broadcast, resell, sublicense, or publicly distribute Course videos, audios, PDFs, exercises, or community content.

  • Remove copyright notices, watermarks, or attribution.

  • Record, scrape, or create derivative works from the Course content, except as permitted above for printed hymnals/scores explicitly marked as such.

  • Use Course materials to create competing offerings, trainings, or compilations.

  • Share your login or enable others to access the Course via your account.

5) Intellectual property

All Course content and associated materials are owned by GCA or its licensors and are protected by copyright and other IP laws. No title or ownership transfers to you. All rights not expressly granted are reserved.

6) Payments, taxes & pricing

  • You agree to pay the listed price (plus applicable taxes/fees) at time of purchase.

  • Prices and payment plans may change prospectively.

  • You are responsible for any sales/VAT/GST/import taxes and bank/FX fees.

  • If a payment fails, we may suspend access until resolved.

7) Refund policy

We aim to be fair and transparent:

  1. Standard refund window (non-EU/UK consumer distance sales laws):
  • 60-day satisfaction guarantee from the purchase date or from the date Course access is first provided (whichever is later).

  • To qualify, you must (i) request within the window and (ii) have completed less than 20% of the Course (as measured by the LMS).

  • After the window, refunds are generally not available except where required by law.

  1. Beta / pre-order enrollments:
  • If you enrolled in a beta or pre-release, the Course may be delivered iteratively. Access to an upgraded or successor version counts as delivery so long as substantially equivalent or improved content is provided.

  • Migrations and iterative releases do not reset or extend the refund window.

  1. EU/UK cooling-off:
  • If you are in the EU/UK, you may have a 14-day cooling-off period for digital content purchased at a distance.

  • However, once you start accessing the digital Course (or expressly consent to immediate access), you acknowledge your right to withdraw may be lost to the extent permitted by applicable law. We will present a clear acknowledgement of this at checkout where required.

  1. Duplicates & billing errors:
  • Duplicate charges or verifiable billing errors will be refunded.

  1. How to request a refund:
  • Email support at [email protected] or via the contact page on the GCA website with your full name, purchase email, order ID, and reason.

  • We process eligible refunds to the original payment method where possible.

  1. Chargebacks:
  • Please contact us first so we can help. If you file a chargeback without giving us a chance to resolve, we may provide documentation of access and policy acceptance to the card network.

8) Student conduct & community

You agree to respectful conduct in communities, forums, live sessions, and workshops. We may moderate, suspend, or remove access for harassment, abuse, illegal activity, or violations of these Terms.

9) Third-party tools & links

The Course may integrate third-party platforms (e.g., LMS, video hosting, communities). Their terms and privacy policies apply to your use of those services. GCA is not responsible for third-party failures or acts/omissions.

10) Support

We will provide reasonable Course support via [email protected] (or any other support email address) during normal business hours (Idaho, USA), excluding holidays.

11) Disclaimer of warranties

To the maximum extent permitted by law, the Course is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free access, or that outcomes (musical or otherwise) will meet your expectations.

12) Limitation of liability

To the maximum extent permitted by law:

  • GCA will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits/revenues/data.

  • GCA’s total liability for any claim related to the Course will not exceed the amount you paid for the Course in the 12 months preceding the claim.

  • Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the minimum extent permitted by law.

13) Indemnity

You agree to defend, indemnify, and hold harmless GCA, its owners, instructors, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Course; (b) your breach of these Terms; (c) your violation of law or third-party rights; or (d) content you submit or share.

14) Suspension & termination

We may suspend or terminate access (with reasonable notice where practicable) if you materially breach these Terms, engage in fraud/abuse, or if required by law or third-party platform rules. In appropriate cases we may provide a prorated refund in our discretion where required by law.

15) Changes to the Course or Terms

We may update the Course and these Terms from time to time. Material changes will be posted with a new “Last updated” date. Continued access after changes constitutes acceptance. If you do not agree, you may stop using the Course and—if eligible—request a refund under Section 7.

16) Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., platform outages, acts of God, war, strikes, governmental actions).

17) Dispute resolution

Before initiating formal action, both parties agree to try to resolve disputes in good faith by emailing [email protected] or via the contact page on the GCA website. If unresolved after 30 days, either party may pursue legal remedies in the courts of Idaho (small-claims included) unless a different forum is mandated by non-waivable consumer law of your country.

18) Miscellaneous

  • Severability. If any provision is unenforceable, the remainder remains in effect.

  • No waiver. Failure to enforce a provision is not a waiver.

  • Assignment. You may not assign your rights without our written consent. We may assign as part of a reorganization or sale.

  • Entire agreement. These Terms (plus any written enrollment page/policy referenced at checkout) are the entire agreement regarding the Course and supersede prior communications.
